Terms and Conditions
1. Website operator and contracting entity
FuelGuard is a trading brand. The legal entity contracting with a customer is identified on the applicable quotation, order confirmation or invoice. References to “FuelGuard”, “we” or “us” should be read with that commercial document.
2. Website information
Product descriptions, specifications, illustrations, pricing and availability are provided in good faith and may be updated without notice. A website listing is an invitation to place an order and does not by itself guarantee stock, suitability or acceptance.
3. Orders and acceptance
An order is subject to verification of product configuration, stock, delivery requirements, payment and any application information reasonably required. A binding sale is concluded when the order is accepted or an applicable quotation is accepted in accordance with its terms.
4. Prices and payment
Prices are displayed in South African rand unless stated otherwise. The checkout, quotation or invoice will indicate the applicable price, payment method and whether any taxes, delivery charges or additional services apply. Payment must clear before dispatch unless written credit terms have been approved.
5. Product application and suitability
Customers must provide accurate information about the fuel type, operating environment and intended use. Product guidance is based on the information supplied and does not remove the customer’s responsibility to follow safety procedures, instructions, specifications and applicable laws.
6. Field screening limitation
DensiTest, hydrometer kits, AquaTrap™ and other FuelGuard products support operational screening, observation, early detection and evidence collection. They do not constitute accredited laboratory certification and must not be represented as conclusive proof of fuel composition, adulteration or formal specification failure unless supported by the appropriate analysis.
7. Safety
Fuel is hazardous. Products must be used by competent persons in suitable conditions with appropriate personal protective equipment, ventilation, ignition-source control, spill management and site procedures. Instructions supplied with a product form part of the terms of use.
8. Delivery and risk
Delivery estimates are indicative unless expressly guaranteed in writing. Risk, inspection requirements, delivery location and collection arrangements are dealt with in the Shipping and Delivery Policy and the applicable order confirmation.
9. Returns, defects and warranties
Returns and defect claims are handled under the Refund and Returns Policy, any manufacturer warranty and applicable consumer law. Products must not be used after a defect or safety concern becomes apparent.
10. Intellectual property
FuelGuard™, DensiTest, AquaTrap™, product designs, instructions, photographs, graphics, software concepts and website content may be protected by intellectual-property rights. No right to reproduce, reverse engineer, rebrand or commercially distribute these materials is granted unless agreed in writing.
11. Account and website security
Users are responsible for maintaining the confidentiality of account credentials and for activity performed through their account. Attempts to interfere with website security, extract data unlawfully or misuse ecommerce functions are prohibited.
12. Liability
Nothing in these terms excludes liability that cannot lawfully be excluded. To the extent permitted by law, FuelGuard is not responsible for losses caused by incorrect product use, unsafe fuel handling, inaccurate customer information, failure to follow instructions, unapproved modification or reliance on field screening as laboratory confirmation.
13. Force majeure
We are not responsible for delay or non-performance caused by events reasonably beyond our control, including supplier interruptions, transport disruption, infrastructure outages, industrial action, severe weather or regulatory restrictions.
14. Governing framework
These terms are intended to operate under the laws of the Republic of South Africa. Mandatory consumer rights remain applicable where they cannot lawfully be excluded or limited.
15. Enquiries and disputes
Commercial or technical enquiries should be submitted through the contact page with the order, quotation or invoice reference. We will first attempt to resolve a dispute through direct written engagement.
